Terms of Sale

 

With regard to your purchases from this site History and Relics LLC or the third-party payment processing service utilized will communicate electronically by email. You agree that all agreements, notices, disclosures and other communications that are provided electronically satisfy any legal requirement that such communications be in writing. Please note that these Sales Terms give you specific rights, and you may have other rights, which vary from jurisdiction to jurisdiction.

 

1. About These Sale Terms

 

These Sales Terms only apply to purchases made in this Online platform.

 

By making a purchase for products, you agree to be bound by and accept these sales terms.  

 

2. Making a Purchase Order

 

Please note that History and Relics LLC only ships purchased Products within the United States.

 

To be able to buy Products you must:

 

• Provide your name and address, phone number, email address, payment details and other required information.

• Be at least 18 years of age.

• Provide a delivery address in the United States

• Be the owner or authorized holder of a valid debit/credit card. You may place an order by clicking on the "Add to cart" button and proceeding to the checkout page.

 

3. Prices, Errors, Cancellations, Charges of Taxes

 

The price charged for a Product will be the price in effect at the time the purchase is made and will be set out in the receipt and purchase confirmation emails. History and Relics LLC may change prices at any time without notice.

In the event a product is listed at an incorrect price due to typographical error or error in pricing or other information, History and Relics LLC will have the right to cancel purchases of any such product, whether or not the order has been confirmed and/or your credit card or other payment method has been charged. If your credit card has already been charged for the purchase and your order is cancelled, we will refund any such charges within a commercially reasonable period of time after cancellation.

History and Relics LLC reserves the right, without prior notice, to limit the order quantity on any product or service, to refuse service to any customer, or to cancel any order, including after it is submitted.

 

History and Relics LLC charges sales tax where required by law. If you are shipping to states where sales tax is charged, the appropriate charges will be added to your merchandise total and displayed in your Purchase Order. Prices for the Products do include charges for shipping and handling unless otherwise specified.

 

4. Product Availability, Shipping and Delivery, Circumstances Beyond Reasonable Control

 

History and Relics LLC does not guarantee the availability of any Product in the Online Shop. This is especially true should a product be sold out and the website not updated to reflect such. History and Relics LLC reserves the right, without liability or earlier notice, to change, discontinue or stop selling any Product.

History and Relics LLC strives to make shipping free of charge whenever possible. However, there may be instances where shipping charges may be required such as when heavy packages are involved. In those unique circumstances, shipping charges will be disclosed. However, for most everything else, shipping is free.

History and Relics LLC utilizes many professional shipping and delivery services such as USPS, UPS, and FedEx. The delivery service that History and Relics LLC selects is generally standard mail or delivery service or priority service unless otherwise disclosed or requested by the buyer beforehand. Shipment tracking information is obtained for the benefit of both parties in the transaction. Signature confirmation and/or insurance will be at the discretion of History and Relics LLC unless otherwise noted or as requested by the buyer beforehand.

History and Relics LLC does not ship any products or items internationally at this time. 

 

History and Relics LLC prides itself in packaging each item it sells as carefully as possible for protected traveling and to ensure safe delivery to you. From time to time History and Relics LLC may opt to have the shipping or delivery service vendor pack the items for transport. This is especially true for large, heavy, or extremely fragile items.

 

In the event your package does not arrive, History and Relics LLC will work with the shipping and delivery service provider to track and attempt to remedy the issue and get your package delivered as soon as possible.

 

In case you unreasonably defer delivery or delay the receipt of delivery after History and Relics LLC or the shipping or delivery service has notified you that they have tried to deliver the ordered items to you, or if you have provided History and Relics LLC with an incorrect delivery address which results in an unsuccessful delivery, the delivery package will be returned to History and Relics LLC.

 

If the items remain undelivered and are returned to History and Relics LLC undelivered, History and Relics will consider that you have exercised your right to cancel the purchase order and when History and Relics LLC receives the returned package, History and Relics LLC will refund you less any reasonable additional costs incurred during the process.

 

History and Relics LLC is not responsible nor liable for any damages as a result caused by the shipping and delivery service provider. If insurance was obtained, details or guidance will be provided as to next steps you may need to follow in a claim process with the shipping and delivery service utilized.  

 

History and Relics LLC cannot be held responsible nor held liable for lost or stolen items especially in cases where the shipping or delivery service shows delivery as being perfected. 

 

History and Relics LLC shall not be held responsible for delay or failure to perform if the delay or failure is caused by any circumstances beyond its reasonable control including but not limited to acts of war or terror, strikes, national or local states of emergency, failure of transportation facilities, power or utility outages, earthquakes, or other natural disasters.

 

5. Payment

 

Payment by credit/debit cards shall be made by through an acceptable and approved payment portal as approved by History and Relics LLC. You have to supply your payment card details when you make your purchase.  Your credit card may not be accepted if: (1) the name on the credit card does not match the billing name given or (2) the billing address given does not match the bank records. Your payment card will be charged upon purchase of the items. History and Relics LLC will not supply the items to you until your card issuer has authorized the use of your card for payment of the purchased products. As your purchase order confirmation email is your proof of purchase, we recommend that you save and print that document for your potential future use.

 

Acceptable Payment Portals: PayPal and Wix Payment Platforms. Through these portals, all major credit/debit cards are generally accepted such as VISA, MASTERCARD, etc.

 

6. Title to Products

 

History and Relics LLC retains full legal title to Products until it has received all amounts due from the buyer.

 

7. Returns and Refunds,

 

History and Relics LLC does not accept returns, exchanges, nor issues refunds for any items where a third-party authentication service was utilized. This includes sportscards, photos, games used items, autographs, memorabilia or collectibles, etc. that may have been authenticated by such entities as BGS, BVG, SGC, PSA/DNA, MEARS, CGC, or any other similar type service. In these instances, All Sales Are Final.

History and Relics LLC makes every effort to research its items in an effort to confirm authenticity and to accurately describe the item and its condition as best as possible. However, should an item be found not as described or for autographed and memorabilia type items not authenticated by a third-party authentication service be found not genuine, the buyer will have 14 days by which to report and return the item. Upon safe return of the item in question, the buyer will receive a full refund. 

 

8. Liability

 

These Sales Terms set out the extent of History and Relic LLC’s obligations and liabilities in respect of the sale of products.

 

History and Relics LLC disclaims any implied or express warranty of, and assumes no responsibility for, defects in workmanship caused by manufacturers or other third parties who are not acting on History and Relic LLC’s behalf or modifications made to the products by anyone other than History and Relics LLC or those authorized by History and Relics LLC. History and Relics further disclaims all liability and damages of any kind related to use of products in any manner which is not consistent with the product's intended use.

 

9. General

 

If any provision or provisions of these Sales Terms shall be held to be invalid, illegal or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired.
